ANJANA MISHRA ORAL ORDER 15-12-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Pasraha P.S. Case No.31 of 2014 for allegedly having committed the offence under Sections 406 and 420 of the Indian Penal Code.
On the last occasion, O.P. No.2 had appeared and a copy of the petition had been served on the learned counsel appearing on behalf of O.P. No.2. However, there is no representation on his behalf today.
Having heard learned counsel for the petitioner and
Patna High Court Cr.Misc. No.58555 of 2015 (8) dt.15-12-2016 2/2 the learned counsel appearing on behalf of the State and in view of the fact that the matter had earlier been referred to the Mediation Centre, where the mediation has failed and that there is no resistance on behalf of O.P. No.2, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Khagaria, in connection with Pasraha P.S. Case No.31 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
