The petitioner who is in custody since 23.11.2014 in connection with Chakia P.S. Case No. 279 of 2013 registered for the offence under Section 385 and 387 of the Indian Penal Code has prayed for grant of bail.

Learned counsel for the petitioner submits that on the basis of confessional statement of the co-accused in an another case the petitioner name has transpired and he is in custody since long.

Learned A.P.P. opposes the prayer of bail. He submits that petitioner is accused in number of cases. Keeping in view the nature of accusation and the period

No.57664 of 2015 (2) dt.21-01-2016 2/2 of custody, let the petitioner Awanish Kumar Singh @ Awanish Kumar be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Chakia P.S. Case No. 279 of 2013 with a condition that the one of the bailors must be blood relation of the petitioner and secondly during the trial the petitioner shall remain physically present on each and every date. If continuously on two dates the petitioner fails to appear without prior permission of the trial court, his bail bound shall stand automatically cancelled.
