The petitioner seeks pre-arrest bail in connection with Madhepura P.S.Case No. 239 of 2017 registered under Section 7 of the E.C. Act.

It is submitted by the learned counsel for the petitioner that save and except the fact that the petitioner is the owner of the vehicle, which was plying on hire and the rice loaded upon it was suspected to be subsidized rice of the Government scheme, there is no other material against the petitioner to connect him with the alleged offence.

Learned counsel for the State opposed the application for grant of pre-arrest bail of the petitioner.

No.1339 of 2018 (2) dt.19-01-2018 2/2 Having regard to the nature of allegation and the submissions made above, in the event of arrest or surrender before the court below within four weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in connection with Madhepura P.S.Case No. 239 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
