2. The petitioners seek bail in a case registered for offence under Sections 126(2), 115(2), 118(2), 109, 103(1) 351(2), 352, 3(5) of the B.N.S., 2023.
3. As per F.I.R., due to old land dispute, all the F.I.R. named accused persons including these petitioners called informant's father and mother to settle the matter through panchayati and in course of panchayati between the parties, there was hot talk between informant's father and Umed Lal Pandit (petitioner no. 2) and thereafter, all the accused persons dragged them in the house and brutally assaulted. Petitioner no. 2 is alleged to have pressed the neck of informant's father, whereas co-accused Indu Bhushan Pandit assaulted on the chest

No.61482 of 2025(3) dt.10-11-2025 2/3 of informant's father with brick and petitioner no. 1 (Uma Shankar Pandit) alongwith co-accused Ravi Kumar Pandit and Arun Pandit were catching hands & legs of informant's father, on account of which, father of informant died on spot and informant's mother sustained some injuries.
4. Learned counsel for the petitioners submits that on account of land dispute between the parties, simple marpit took place in which, father of informant sustained injuries and died. Allegation of assault is general and vague against all accused persons. Petitioners have got clean antecedent and are in custody since 07.06.2025. Chargesheet has been submitted.
5. Learned counsel for the informant vehemently opposes the prayer for bail and submits that petitioners are named in the F.I.R. and there is specific accusation against petitioner no. 2 that he pressed the neck of deceased.
6. Considering the aforesaid facts and circumstances, the prayer for bail of petitioner no. 2 (Umed Lal Pandit) is rejected.
7. So far as petitioner no. 1 (Uma Shankar Pandit) is concerned, he is only alleged to have caught hold of leg of the deceased and there is no allegation of overt act against him, let the petitioner no. 1 namely Uma Shanka Pandit be released on
Patna High Court CR. MISC. No.61482 of 2025(3) dt.10-11-2025 3/3 bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Shahpur Patori, District - Samastipur in connection with Mohanpur P.S. Case No. 121 of 2025.
