2. The petitioners apprehend their arrest in a case registered for the offence under Sections 341, 323, 324, 307, 504 and 506/34 of the Indian Penal Code.

3. As per the prosecution case, petitioner no. 1 is alleged to have assaulted Sumit Singh by means of Farsa causing injury on his head and petitioner no. 2 assaulted the informant by means of sword causing cut injury on his head.

4. It is submitted on behalf of petitioners that petitioners and informant are co-villagers and there is land dispute between them. For the alleged occurrence, both sides lodged cases against each other. Injury caused by petitioner no. 2 is simple in nature. Petitioners claim clean antecedent.

5. However, learned A.P.P. vehemently opposes the prayer for bail and submits that there is specific overt act against both petitioners and the injury, caused by petitioner no. 1, is grievous in nature.

6. Considering the fact that petitioner no. 1 (Ranjan Singh) caused grievous injury to Sumit Singh, the prayer for anticipatory bail of petitioner no.1 is refused.

7. So far as prayer for anticipatory bail of petitioner no. 2 i.e. Sudhir Singh is concerned, in the event of his arrest/surrender within a period of six weeks from today, he is directed to be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Nautan P.S. Case No. 54 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
