The petitioners apprehend their arrest in Akorhigola P.S. case No. 134 of 2017 under Section 379, 452, 323 and other Sections of the Indian Penal Code.
The informant alleged that petitioners entered into his house and assaulted the informant and other family members only because his family members brought 1 1⁄2 year son of Renu Devi, wife of Dinanath Singh, to his house as Renu Devi fled away from the house after leaving the child.
The learned counsel for the petitioners submits that prior to institution of this case, Akorhigola P.S. case 132 of 2017 has been registered at the instance of Bhuneshwar Singh under Section 498A, 312/34 of the IPC against Dinanath Singh and
Patna High Court Cr.Misc. No.57384 of 2017 (2) dt.04-01-2018 2/2 others. Renu Devi, the sister of petitioners Nos. 2, 3 and 4, was married to Dinanath Singh but Dinanath Singh and his family members subjected Renu Devi to all sorts of torture and they drove her out from the house and when the petitioners went to enquire about the Renu Devi, Ashok Singh, next door neighbour of Dinanath Singh, lodged this case making false and frivolous allegation.
Considering the facts aforesaid and the nature of allegation made against the petitioners, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub divisional Judicial Magistrate, Dehri, Rohtas in connection with Akorhigola P.S. case No. 134 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
