2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 302 (2), 317 (2) and 3 (5) of the BNS.

3. The case of the prosecution is that the petitioner along with two others is alleged to have stolen three bundles of aluminum cable worth Rs. 3,12,196/-

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that upon perusal of the seizure list, it would transpire that the Aluminum coil Worth Rs. 3,12,196/ has been recovered from the possession of co-accused, namely Jai Kishan. Patna High Court CR. MISC. No.61853 of 2025(2) dt.08-09-2025 2/2 further submitted that nothing has been recovered from his conscious possession. Moreover, the petitioner has been languishing in judicial custody since 18.05.2025 having no criminal antecedent.

5. Learned counsel appearing on behalf of the State has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Buxar Muffasil P.S. Case No. 214 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar.
