JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-01-2016 Heard learned counsels for the petitioner and the State. The petitioner being husband of the informant is languishing in custody since 8.9.2015 in a case registered for the offences punishable under Sections 494 and 498A/34 of the Indian Penal Code.
The basic accusation is of torture and performance of second marriage.
It is submitted by the learned counsel for the petitioner that the petitioner has not performed second marriage. Statement to that effect has been made in paragraph 8 of the petition which reads as follows:
"That the petitioner has not remarried with any one, the
Patna High Court Cr.Misc. No.579 of 2016 (2) dt.05-01-2016 2/2 allegation levelled against the petitioner is false." It is further submitted that the petitioner is still ready to keep the informant as wife with full dignity and honour. Statement to that effect has been made in paragraph 9 of the petition which reads as follows:
"That the petitioner still ready to keep wife with full dignity and respect."
More over, the investigation has already concluded. Considering the fact that the investigation has already concluded, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. I, Patnacity in connection with Gaurichak P.S. Case No. 184 of 2014.
