JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-02-2018 Petitioner apprehends his arrest in connection with Beldaur P.S.Case No. 188 of 2017 registered for the offences under Sections 409, 420 and 34 of the Indian Penal Code. Allegation against the petitioner is that he misused the amount allotted for construction of toilet under the Scheme of the year 2007-08.

Submission of learned counsel for the petitioner is that this is not a case of misuse of amount rather in place of particular place construction has been made in other place and co-accused have been granted privilege of anticipatory bail by a co-ordinate Bench of this Court in Cr.Misc.No. 4431 of 2018, vide order dated 1.2.2018.

Heard learned APP also, who has not controverted the

Patna High Court Cr.Misc. No.3815 of 2018 (2) dt.05-02-2018 2/2 above submission.

In the facts and circumstances, let the petitioner, above named, surrender within a period of six weeks and on his so surrendering he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria, in connection with Beldaur P.S.Case No. 188 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions that (1) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and (2) petitioner shall co-operate in investigation of the case and appear before the Investigating Officer as and when required, except on genuine ground, failing which his bail bond shall be cancelled.
