2. The petitioner seeks bail in a case registered for the offence punishable under Sections 498A and 304B of the Indian Penal Code.
3. The daughter of the informant is said to have been killed by the petitioner by sprinkling kerosene and to lit fire on her.
4. It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He is quite innocent and has been falsely implicated in this case. It is further submitted that the petitioner is a daily wage labourer working as a Painter and have been rearing up singly two small children out of the deceased wife. He is the sole bread earner for
Patna High Court CR. MISC. No.64517 of 2024(3) dt.18-10-2024 2/2 his two small children. The petitioner has one criminal antecedent and has been languishing in custody since 06.07.2024.
5. Learned APP for the State vehemently opposing the bail petition submitted that considering the nature of the offence, the petitioner does not deserve bail.
6. In the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. The prayer for bail is hereby rejected. However, the petitioner would be at liberty to renew his prayer for bail after framing of charge. (Anjani Kumar Sharan, J) Trivedi/- U T
