The petitioner seeks bail in Dumraon P.S. Case No. 331 of 2021 (NDPS Case No. 30/2021), registered for the offence punishable under Sections 20/22 of the Narcotic Drugs and Psychotropic Substances Act.

As per the FIR, cash of Rs. 45520/- and one mobile have been recovered from possession of this petitioner. From possession of co-accused Anil Kumar Choudhary 49 pudia of Heroin weighing 36.12 gm has been recovered.

It is submitted on behalf of the petitioner that no narcotic substance has been recovered from possession of this petitioner. Narcotic substance has been recovered from possession of co-accused. The alleged amount which is said to have been recovered from possession of this petitioner belongs

Patna High Court CR. MISC. No.70727 of 2021(2) dt.07-03-2022 2/2 to one Taj Mohammad Rain who is wholesaler of fruit in Dumraon market and petitioner was working as Manager in his shop in support of the same annexed paper vide Annexure-2. Petitioner claims clean antecedent and he is in custody since 21.08.2021. Investigation is complete.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge Vth, Buxar in connection with Dumraon P.S. Case No. 331 of 2021 (NDPS Case No. 30/2021).
