JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 11-04-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Hulasganj P.S. Case No. 74 of 2015 registered under Sections 409 and 420/34 of the Indian Penal Code.

It is contended that the entire allegations made in the FIR are quite vague. The petitioner was transferred from Hulasganj Block to S.D.O. Office, Jehanabad in the year 2008. He retired from service on 31st July, 2014 and is being paid his retrial dues. It is further contended that at no point of time the petitioner was either proceeded departmentally or any explanation was asked from him in respect of the record which is found missing from the said Block Office.

Regard being had to the facts and circumstances of the

Patna High Court Cr.Misc. No.58638 of 2015 (3) dt.11-04-2016 2/2 case, in the event of arrest or surrender in the court below within four weeks from today, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Sri D. Kumar Yadav, learned Judicial Magistrate, 1st Class, Jehanabad in connection with Hulasganj P.S.Case No.74 of 2015 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
