This application, for grant of anticipatory bail, arises out of Chainpur P.S. Case No. 232/2017, disclosing offences under Sections 420, 467, 468, 409 and 34 of the Indian Penal Code. The petitioner was Revenue karmchari posted at Chainpur block in the district of Bhabhua. Allegedly, he issued rent receipt in respect of a land in favour of one Kaushar Ansari despite having the knowledge that the application filed by Kaushar Ansari for mutation of the land had been rejected by the Circle Officer twice.

Learned counsel for the petitioner has submitted that since the co-accused Kaushar Ansari has produced before him the

Patna High Court Cr.Misc. No.57453 of 2017 (2) dt.13-12-2017 2/2 Correction Certificate/Shuddhi Patra in respect of mutation, the petitioner acting bona fide had issued rent receipt. It is being submitted that the petitioner neither benefited in anyway by issuing rent receipt nor there is any allegation against him of having obtained any undue benefit from any corner. Considering the whole submission, this application is allowed. Let the petitioner above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate - II, Kaimur at Bhabhua, in connection with Chainpur P.S. Case No. 232/2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
