The petitioner apprehends his arrest in Bind P.S. Case No. 18 of 2021, registered for the offences punishable under Sections 307, 379 and other allied sections of the Indian Penal Code and section 27 of the Arms Act.

On secret information that a tractor was set on fire at village Utarthu, informant (police official) along with team went at the place of occurrence and found 20-25 persons there who after noticing the police party managed to flee away. Informant saw two tractors were burnt at river and he came to know that those persons did 5-6 round firing and they came to steal sand and they had burnt the tractors.

It is submitted that petitioner is driver of one of the

Patna High Court CR. MISC. No.69936 of 2021(2) dt.19-07-2022 2/2 tractors. There is no allegation of any specific overt act against this petitioner. In fact, petitioner was going to bricklin for transportation of picket and on the way some of the person set the tractor on fire. Petitioner claims clean antecedent. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate III, Nalanda at Biharsharif in connection with Bind P.S. Case No. 18 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
