The petitioners have preferred this application for grant of regular bail in a case registered under sections 419, 420 and 34 of the Indian Penal Code.

As per the prosecution case, the accused persons including the two petitioners herein were taking Rs. 1000/- each from the villagers on the promise that they would get them flood relief of Rs. 6000/- from the administration. It is submitted by learned counsel for the petitioners that the petitioners have been falsely implicated in the case. No incriminating article has been recovered from their

Patna High Court CR. MISC. No.69925 of 2021(2) dt.16-02-2022 2/2 possession. They are in custody since 20.9.2021 and have no criminal antecedent. Chargesheet has been submitted in the case. It is further submitted that the marriage of the daughter of the petitioner no.2 is fixed for 18.2.2022.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the nature of allegation and chargesheet having been submitted in the case, the Court directs the petitioners to be enlarged on bail in connection with Turkauliya (Banjariya) P.S. Case no. 736 of 2021 on each of them furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran.
