22-11-2017 Heard Sri Ashok Kumar Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, having clean antecedent which fact has been stated in paragraph - 3 of the petition apprehending his arrest in Amba P.S. Case No. 27 of 2016 registered for offence under Sections 272, 273 of the Indian Penal Code and Section 47 of the Bihar Excise (Amendment) Act, 2016, has prayed for grant of bail in the event of his arrest or surrender. It was submitted by learned counsel for the petitioner that petitioner in the present case has been made accused only on the ground that he was registered owner of a motorcyle, which was intercepted by the police and police made out a case that two occupants of the motorcycle fled away after noticing the police and motorcycle was loaded with about 40 liters
Patna High Court Cr.Misc. No.37641 of 2017(3) dt.22-11-2017 2/2 country-made liquor. A plea has been taken that long back the said motorcycle was sold to other on a revenue stamp, however; the petitioner due to ignorance did not take step to get the name changed in the register being maintained in the D.T.O. office. Be that as it may, considering the nature of accusation and clean antecedent of the petitioner, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner namely Jitendra Singh be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge - VII cum Special Judge, Aurangabad in connection with Amba P.S. Case No. 27 of 2016, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
