Petitioner apprehends his arrest in a case filed under Sections 409 and 420 of the Indian Penal Code. It is submitted that the petitioner has lifted 6222 quintals of paddy and he deposited 3509 quintals of rice after milling the aforesaid paddy but could not deposit rest 659.74 quintals of rice. The amount equivalent to the aforesaid rice comes to the tune of Rs.14,28706.55/-. It is contended that a proceeding under the Public Demand Recovery Act has already been instituted and he has pledged his properties of value of

Having regards to the facts and circumstances of the case, in the event of arrest/surrender within a period of six weeks from today in Sasaram (Muffasil) P.S. Case No.1173 of 2015, the above named petitioner, Ramswaroop Singh @ Ram Swarath Singh shall be released on bail on furnishing bail bond of Rs.10,000( Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, District- Rohtas (Sasaram) subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure with a further condition that the petitioner would deposit 15% of the due amount within a period of six months and will file necessary papers before the court below showing such payment in favour of the Bihar State Food and Civil Supplies Corporation failing which the court concerned would take steps for cancellation of the bail bonds of the petitioner.
