====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 03-01-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 304(B)/201/34 of the Indian Penal Code.

Allegedly, the petitioner along with other co-accused persons assaulted and tortured the informant's daughter for dowry of cash and one motorcycle. The informant suspects that her daughter has been killed by her-in-laws for dowry. It is submitted by learned counsel for the petitioner that she is quite innocent and has not committed any offence as alleged in the aforesaid FIR. Patna High Court CR. MISC. No.58517 of 2022(2) dt.03-01-2023 2/2 extort some monetary benefit from the father of the petitioner and also to defame and demoralize the petitioner and her family. Petitioner has no concern with the incident in any manner. The petitioner is niece of accused no.1 and co-resident of the informant's village. It is further submitted that husband of the deceased is already in judicial custody. There is general and omnibus allegation against her. Petitioner has no criminal antecedent as mentioned in para-3 of this application. Learned APP for the State opposed the prayer for bail.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Udwant Nagar P.S. Case No. 419 of 2021, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
