JUSTICE PURNENDU SINGH ORAL ORDER 30-09-2024 Heard Mr. Sanjay Kumar, learned counsel appearing on behalf of the petitioner and Mr. Madanjeet Kumar, learned GP-20 appearing on behalf of the respondents.

The petitioner in paragraph no. 1 of the present writ petition has sought inter alia following relief(s), which is reproduced hereinafter: "(i) For issuance of a writ in the nature of mandamus thereby commanding or directing or ordering the respondents Collector, Madhubani to direct for physical verification of the residential house of the petitioner for mapping of the families permanently residing in ward No. 3 of Panchayat Pachrukhi under Anchal Babubarhi of District Madhubani by making visit to each and every residential house of each and every family and if the petitioner's family is found to be permanently residing in the aforesaid ward No. 3 then she should be appointed on the post of Anganwari Sevika of the aforesaid ward No. 3. (ii) That for issuance of a writ in the nature of certiorari thereby quash the order dated 06.01.2024 passed in Anganwari appeal case No. 71/2023 by the Court of Collector, Madhubani preferred by this petitioner to the extent whereby the Collector has directed to initiate fresh selection process whereas

(iii) Any other order or orders which this Hon'ble Court finds fit and proper in the given facts and circumstances may kindly be passed."

Considering the relief as sought for in the present writ petition, and in view of the law laid down by the Apex Court in the case of State of Karnataka & Others vs Ameerbi and others, reported in (2007) 11 SCC 681, this Court is not inclined to grant relief to the petitioner. However, the petitioner may approach the appropriate authority in accordance with the provision of guidelines, for the relief as sought for in the present writ petition.
