JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 379 of the Indian Penal Code. According to prosecution case itself, one co-accused, Chhotu Yadav was caught on the spot and disclosed that he along with co-accused, Lakhan Bind had gone to commit theft. Moreover, co-accused, Lakhan Bind was arrested and disclosed the name of the petitioner which was subsequently seconded by one witness, namely, Sangita Devi. Petitioner does not have any criminal antecedent and is languishing in jail custody since 13.01.2016.
