JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 27-09-2022 Heard learned counsel for the petitioners and learned APP for the State and perused the case diary. The petitioners are apprehending their arrest in a case registered for the offences punishable under Section 302 of the Indian Penal Code.

Allegedly, it is a case of murder of deceased, namely, Anita Devi by the petitioners and other accused persons. It is submitted by learned counsel for the petitioners

Patna High Court CR. MISC. No.69907 of 2021(4) dt.27-09-2022 2/2 that the petitioners have falsely been implicated in this case. He further submits that the petitioners are not named in the FIR and the name of the petitioners came into light on the basis of the confessional statement of co-accused Mukesh Kumar. He further submits that there is no legal evidence against the petitioners and there are no witnesses except confessional statement of main co-accused Mukesh Kumar as well as there are no other materials against the petitioners. Petitioners have clean antecedent.

Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submissions, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM, Sherghati, Gaya in connection with Barachatti (Mohanpur) P.S. Case No. 349 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
