1. Heard Mr. Baijnath Sah, learned counsel for the petitioner and Mr. Md. Ataur Rahman, learned APP for the State.

2. The petitioner apprehends his arrest in connection with RPF/Post/Kahalgaon P.S. Case No. 813 of 2024 dated 02.05.2024 registered for the offences punishable under Sections 154 and 160(2) of the Railway Act, 1989.

3. Learned counsel for the petitioner submits that the instant matter relates to damage to the railway crossing gate but no serious damage was found, in fact only crack to the said gate was found. Learned counsel further submits that against this petitioner, there is no allegation of having caused the alleged damage intentionally and the instant matter relates to a

4. Learned APP for the State has opposed the prayer for bail.

5. Considering the facts and circumstances of this case as well as above submissions coupled with petitioner's fair and clean antecedent, this Court is inclined to grant the relief of anticipatory bail to him. Accordingly, let the petitioner namedabove, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned in connection with RPF/Post/Kahalgaon P.S. Case No. 813 of 2024, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
