The petitioner apprehends his arrest in a case registered for the offence under Sections 147, 149, 341, 323, 325, 406, 420, 467, 468, 471, 379, 504, 354(A)/34 of the Indian Penal Code.

It is alleged that this petitioner has fraudulently taken loan against the land of the informant. It is further alleged that when the informant demanded his share, all the accused persons including this petitioner abused and assaulted him and his family members.

It is submitted on behalf of petitioner that from perusal of the F.I.R., it is apparent that the dispute is civil in nature. Injury, sustained by the informant and his family, is simple in nature. Informant is none else but own uncle of this petitioner and due to dispute over share of property, this false and concocted case has been lodged.

Patna High Court CR. MISC. No.58519 of 2022(4) dt.01-05-2023 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the nature of accusation and relation between the parties, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. District and Sessions Judge III, Patna City (Patna) in connection with Nadi P.S. Case No. 181 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
