2. The petitioner has preferred this application for grant of regular bail in connection with Fulwaria P.S. Case No. 111 of 2017 dated 25.09.2017 registered for the offences punishable u/s 395, 397 of the Indian Penal Code.

3. As per the prosecution case, while the informant along with his associates was returning from Alapur Branch by taking Rs. 20,00,000/-, six unknown miscreants on two motorcycles looted the entire amount on the point of pistol.

4. It is submitted by learned counsel for the

Patna High Court CR. MISC. No.62082 of 2024(2) dt.18-09-2024 2/3 petitioner that the petitioner is innocent and he has falsely been implicated in the present case. Neither the petitioner is named in F.I.R. nor he has been put on T.I.P. Nothing incriminating has been recovered from his possession. The name of petitioner has sprung up in this case in the confessional statement of co-accused Manish Sahani. Moreover, the petitioner is languishing in judicial custody since 03.05.2024. Similarly situated co-accused persons have been granted bail by the co-ordinate Bench of this Court.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Begusarai in connection with Fulwaria P.S. Case No. 111 of 2017 with the condition:-

No.62082 of 2024(2) dt.18-09-2024 3/3 (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
