JUSTICE RAKESH KUMAR ORAL ORDER 16-02-2016 Heard Smt. Kumari Ritambhara, learned counsel for the petitioners and Sri Awadhesh Kumar Singh, learned Addl. Public Prosecutor.
Seven petitioners, apprehending their arrest in connection with Raniganj P.S. Case no.281/2014 registered for the offence under Section 302 and other allied Sections of the Indian Penal Code and Section 27 of the Arms Act, have prayed for grant of anticipatory bail.
Learned counsel for the petitioners submits that of course in the F.I.R., the informant has made allegation against the
Patna High Court Cr.Misc. No.1594 of 2016 (3) dt.16-02-2016 2/2 petitioners, but fact remains that during investigation, the informant side has filed a petition with an indication that they have not seen the occurrence.
Be that as it may, since in the F.I.R. there is specific accusation against the petitioners and in the occurrence a girl aged about 12 years was done to death by bullet injury, I do not find any ground to extend the privilege of anticipatory bail. The petition stands dismissed.
