The petitioner seeks bail in connection with Sitamarhi P. S. Case No.438 of 2021, instituted for the offences under Sections 30(a), 36 of the Excise Act.
The learned counsel for the petitioner submits that the petitioner is in custody since 16.09.2021, charge-sheet has been submitted in this case and has antecedent of two cases. Allegation is of recovery of 1777.500 litre of liquor from the house of Nagendra Singh.
The learned counsel for the petitioner submits that petitioner was not arrested from the spot and his name came in the confessional statement of co-accused and petitioner is aged about 89 years.
Patna High Court CR. MISC. No.70272 of 2021(2) dt.25-02-2022 2/2 Learned A.P.P. opposes the bail application.
Considering the fact that the petitioner is in custody, charge-sheet has been submitted in this case and was not arrested from the spot and is aged about 89 years, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-11-cum-Special Judge, Excise, Sitamarhi in connection with Sitamarhi P. S. Case No.438 of 2021.
The application stands allowed.
