Petitioner apprehends arrest in case registered for the offences punishable under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

As per prosecution case, on the alleged date and time, when husband of the informant was going to work, on the way at about 09:30 A.M. near Bathana Petrol Pump on N.H.28, this petitioner along with co-accused Suresh Rai came on motorcycle and both of them opened firing which hit on the chest and temple of the husband of the informant as a result of which, he died on the spot.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the

Learned counsel for the State opposes the prayer for bail and submits that there is specific allegation of firing against the petitioner, resulting in death of the husband of the informant.
