The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 379, 307, 427/34 of the Indian Penal Code and section 27 of the Arms Act.

The prosecution case is that while the sister of the informant was alone in her house the petitioner and other accused persons entered into the house with different weapon. It is alleged that co-accused Sambhu Singh, who was armed with pistol, abused the sister of the informant and co-accused Radhe Singh, who was armed with iron rod, snatched her scarf when co-accused Pagla torn her clothes. On alarm being raised when the informant and others came co-accused Shambhu Singh fired

Patna High Court Cr.Misc. No.23027 of 2016 (2) dt.23-05-2016 2/3 and co-accused Suresh Singh gave sword blow to Nagajee brother of the informant. It is alleged against co-accused Radhe Singh that he assaulted by means of iron rod to the informant when co-accused Raju assaulted with tangi whereas this petitioner Satyadev Kumar assaulted on Vijay Singh with butt of the pistol. The co-accused Nagendra Singh ordered to commit robbery in the house of the informant. The co-accused Suresh Singh took away attaché from the house of the informant containing jewellaries and clothes when co-accused Nagendra Singh took away Rs.35,000/ from the truck.

It is submitted by learned counsel for the petitioner that co-accused Nagendra Singh lodged Barahiya P.S. Case No.171/2015 levelling accusation under sections 323/341/448/307/34 of the Indian Penal Code, against the informant's side, hence, the present case has been lodged though there is land dispute between the parties from before. The aforesaid facts constitute ground for consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Barahia P.S. Case No.211/2015, pending before the learned CJM, Lakhisarai.
