JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner along with three to four other unknown persons having entered into the house of the informant made attempt to commit rape on her but the petitioner was caught by the villagers.

The contention on behalf of the petitioner is that petitioner and husband of the informant are friends and as a matter of fact, the husband of the informant had taken some loan from the petitioner and when the petitioner demanded his money, the husband of the informant set up the informant and got instituted the present case.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.491 of 2016 (2) dt.07-01-2016 2/2 well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Sheikhpura in connection with Chewara P.S.Case No.09 of 2015.
