4. This application is disposed of as withdrawn with liberty to the petitioner to prefer an appeal before the Commissioner within 30 days from today.

5. If such an Appeal is filed within 30 days from today, the same shall be considered and decided by the Commissioner concerned on merits after hearing the petitioner. The appeal must be decided within six months of its filing.
