The petitioners apprehend their arrest in connection with Aurangabad (Town) P.S. Case No. 435 of 2015 registered for offences punishable under Sections 341, 323, 324, 307/34 of the Indian Penal Code.

The allegation is that the petitioner no. 1 has assaulted by the knife on the head of the informant and there is general allegation on both the petitioners regarding assaulting him. It is submitted that there are only three wounds. One is lacerated wound on the frontal region, second is abrasion and 3rd is lacerated would on the left temporal region and opinion of the

It is submitted that the petitioners are having clean antecedents and even a compromise petitions has also filed on behalf of both the parties before the court below. It is further submitted that there is no wound by the sharp cutting weapon rather the abrasion and lacerated wounds are caused due to fall on the ground.

Having regard to the facts and circumstances of the case, let the petitioners, namely, Chandan Singh and Gupta @ Jitendra Sao be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Aurangabad (Town) P.S. Case No. 435 of 2015, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
