Permission is granted. The learned counsel for the petitioners is permitted to make correction during course of the day.
This criminal miscellaneous has been filed for restoration of Cr. Misc. No. 51783 of 2014 which was dismissed for want of prosecution on 24.11.2017 as on that date on call no one has turned up for the petitioners.
Heard the learned counsel for the petitioners as well as the learned A.P.P. for the State.
It is submitted that on 24.11.2017 the counsel for the petitioners was seek resulting he could not attend the Court and the case went unrepresented, the situation was beyond the reach
Patna High Court Cr.Misc. No.414 of 2018 (2) dt.10-01-2018 2/2 and, as such, Cr. Misc. No. 51783 of 2014 is fit to be restored as the petitioners are going to suffer irreparable loss and injury. Considering the ground reasonable, Cr. Misc. No. 51783 of 2014 is restored to its original file and number and accordingly, this criminal miscellaneous stands allowed. (Jitendra Mohan Sharma, J.)
