The petitioner apprehends his arrest in Harshidhi P.S. Case No.53 of 2019, registered under Sections 272, 273, 308 and 34 of the Indian Penal Code as well as under Section 30(a) of the Bihar Prohibition and Excise Act.

The police got information about manufacturing of liquor in the house of Yogendra Paswan and on such raid was conducted. One Raju Paswan was apprehended. From the house of Yogendra Paswan, 70 litres country made liquor and 100 pouches each containing 100 ml. country made liquor were recovered. Rajy Paswan, the apprehended accused disclosed the name of the petitioner but nothing has been recovered from the conscious possession of the petitioner. The recovery was made from the house of Yogendra Paswan.

No.60035 of 2019(2) dt.26-09-2019 2/2 Taking into consideration the facts aforesaid and the fact that similarly situated co-accused, Bunnilal Paswan has already been granted anticipatory bail, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 9th Additional Sessions Judge-cumSpecial Judge, Excise, East Champaran, Motihari in connection with Harshidhi P.S. Case No.53 of 2019, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
