The petitioner seeks bail in Kankarbagh P.S. Case No. 26 of 2021, registered for the offence punishable under Sections 399, 400, 402 and 412 of the Indian Penal Code and sections 25(1-b)a, 26 and 35 of the Arms Act.

As per the prosecution case, one pistol with four live cartridges and cash of Rs. 16,59,110/- were recovered from possession of this petitioner.

It is submitted on behalf of the petitioner that no incriminating article has been recovered from possession of this petitioner. Recovered cash belongs to this petitioner and has not found to be the part of looted article. Petitioner is in custody since 09.01.2021.

Patna High Court CR. MISC. No.70297 of 2021(3) dt.25-04-2022 2/2 Learned APP however, vehemently opposed the prayer for bail and submitted that arms and ammunition and looted money have been recovered from possession of this petitioner and petitioner has got criminal antecedent of seven case which are registered in different police stations. Considering the criminal antecedent and recovery of looted article, I am not inclined to enlarge the petitioner abovenamed on bail. Accordingly, the same is rejected.
