Petitioner is named in the first information report but the informant is not an eye witness of actual killing of the deceased and the informant expressed his suspicion against the petitioner on the ground that prior to his death deceased had gone to the house of the petitioner. Furthermore, in course of investigation, one witness claimed that the daughter of petitioner had come at his shop and disclosed that deceased was sitting in her room. It appears that except the aforesaid materials, there is nothing against the petitioner, who does not have any criminal antecedent and is languishing in jail custody since 8.09.2015.
