JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-05-2016 Though the matter has been listed under the heading 'For Orders (on office note)' awaiting service report but since the learned counsel for O.P. No. 2 has entered appearance, the matter is being taken up on merit.

Heard learned counsels for the petitioner and the State. The petitioner being husband of the informant is apprehending arrest in a case registered for the offences punishable under Sections 498A, 406 and 504/34 of the Indian Penal Code and section 4 of Dowry Prohibition Act. The basic accusation is of torture for non fulfillment of dowry demands.

It is submitted by the learned counsel for the petitioner that the petitioner admits his marriage with the informant. The

No.58618 of 2015 (3) dt.02-05-2016 2/2 petitioner filed informatory petition on 28.4.2015 and on the same day the present complaint was filed which cane to be registered as police case on 2.9.2015 though the petitioner also filed Matrimonial Suit No. 187 of 2015 on 22.5.2015 with a prayer for divorce. It is further submitted that the petitioner is not ready to keep the informant as wife though learned counsel for the informant submits that the informant is ready to resume the conjugal life.

Considering the present stand of the petitioner, let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Bhojpur Mahila P.S. Case No. 151 of 2015 pending in the court of learned C.J.M. Bhojpur at Ara. This application is disposed of with the aforesaid observation/direction.
