JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-08-2019 Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the State. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the State. The petitioner had earlier moved for bail which was rejected on 23,03,2017 in Cr. Misc. No. 3838 of 2017. The petitioner is languishing in judicial custody since 04.08.2016 in connection with S. Tr. No. 356 of 2017/84 of 2017 (Hulasganj P.S. Case No. 75 of 2016) for the offences alleged under Sections 364 and 414/34 of the Indian Penal Code. A report was called for from the Additional Sessions Judge, I, Jehanabad, has been received through letter no. 91/2019, dated 17.05.2019, which indicates that four prosecution witnesses have been examined, remaining six witnesses are yet to be examined and the trial will be concluded

Learned Additional Public Prosecutor for the State opposes the prayer for pre-arrest bail.
Having regard to the facts and circumstances of the case, I am not inclined to grant the privilege of bail to the petitioner. The prayer for bail is rejected. However, learned Additional Sessions Judge, V, Jehanabad, is directed to conclude the trial of the petitioner within eight months, failing which the petitioner shall be at liberty to renew his prayer for bail.
