JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-05-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioner no. 1 is said to be father-in-law whereas petitioner no. 2 happens to be brother-in-law of the deceased. The husband of the deceased has already been granted privilege of bail by a co-ordinate Bench of this Court vide order dated 11.03.2016 passed in Cr. Misc. No.2317 of 2016 and the aforesaid fact was brought to the notice of the learned Additional Sessions Judge-III Aurangabad but, even then, the learned Additional Sessions Judge-III, Aurangabad, without giving any weightage to the aforesaid fact, rejected the bail petition of the petitioners, who are languishing in jail custody since16.01.2016.

Patna High Court Cr.Misc. No.18687 of 2016 (2) dt.03-05-2016 2/2 Accordingly, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Daudnagar, Aurangabad in connection with Haspura P.S.Case no. 107 of 2015.
