The petitioner seeks bail in a case registered under Sections 399 & 402 of the Indian Penal Code, Section 25(1b)a/26/35 of the Arms Act and 30(a) of Bihar Prohibition and Excise Act.

Allegedly, three live cartridges were recovered from pocket of the petitioner. It is also alleged that 750 ml. wine is recovered in this case It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 07-07-2019. Charge sheet has already been submitted. Three live cartridges are alleged to have been recovered from pocket of the petitioner.

Patna High Court CR. MISC. No.59967 of 2019(2) dt.24-09-2019 2/2 There is no compliance of Section 100 Cr.P.C. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Muzaffarpur in connection with Sakra P.S. Case No. 335 of 2019.
