JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 28-07-2022 Learned counsel for the petitioners is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioners as well as learned APP for the State.

At the outset, learned counsel for the petitioners has submitted that the petitioner No. 1 has been arrested during pendency of this bail petition. She, therefore, seeks permission to withdraw the anticipatory bail petition in respect of petitioner No. 1. In view of the aforesaid submission, the anticipatory bail petition of petitioner No. 1 is dismissed as withdrawn. The petitioner Nos. 2 and 3 apprehend their arrest in connection with Manjhi P.S. Case No. 221 of 2021, registered for the of-

Patna High Court CR. MISC. No.70063 of 2021(2) dt.28-07-2022 2/2 fences punishable under Sections 341, 323, 324, 379, 504, 307, 34 of the Indian Penal Code.

As per allegation, when the informant was passing through the house of the petitioners, they badly assaulted him. Learned counsel for the petitioners has submitted that for the same day occurrence petitioner No. 2 Sunaina Devi has also lodged a case against the informant and his family members which is registered as Manjhi P.S. Case No. 222 of 2021. she has submitted further that the petitioners are the persons of clean antecedent and injuries suffered by the informant are simple in nature. Considering the above-mentioned facts and circumstances, let the petitioners, in the event of their arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs.

10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Saran at Chapra, in connection with Manjhi P.S. Case No. 221 of 2021, subject to the conditions as laid down under Section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
