JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-03-2016 The present application has been filed for modification of the order dated 28.09.2015 passed in Cr. Misc. No. 11470 of 2015 to the extent that in the last portion of the order it should be read as "Addl. Chief Judicial Magistrate, Benipur" in place of "SDJM, Biroul (Darbhanga)".

The said mistake perpetuated in the order since it was wrongly mentioned in the prayer portion of the petition, hence, learned counsel for the petitioner is permitted to make necessary correction in the prayer portion of main petition. The order dated 28.09.2015 passed in Cr. Misc. No. 11470 of 2015 is modified to the extent let in the last portion of the order be read as "Addl. Chief Judicial Magistrate, Benipur" in place of "SDJM, Biroul (Darbhanga)" and period of surrender is

Patna High Court Cr.Misc. No.1692 of 2016 (2) dt.30-03-2016 2/2 extended by two weeks from the date of receipt/production of the copy of this order in connection with C.R. No. 107 of 2013 pending in the court of learned ACJM, Benipur. It is expected from the petitioner to serve a copy of this order to the complainant within a period of one week when both sides shall appear before the learned court below on 11th of April, 2016 when the petitioner will take the complainant to keep her as wife with full dignity and honour. Rests of the conditions shall remain the same.

Accordingly, the modification application is disposed of.
