The petitioner apprehends his arrest in connection with Barauni, Rail P.S. Case No. 17 of 2010, registered for the offences punishable under Sections 406 of the Indian Penal Code.
At the very outset, the learned counsel for the petitioner submits that this case has been lodged on the basis of complaint case and after investigation the police submitted final form which is evident from order dated 10.12.2010 but the learned Magistrate after differing with the opinion of the investigating officer took cognizance under Section 406 of the I.P.C. against the petitioner resulting, the petitioner is
Patna High Court Cr.Misc. No.4809 of 2018(2) dt.06-02-2018 2/2 apprehending his arrest.
The learned A.P.P. fairly submits that after competing investigation final form was submitted. In the facts and circumstances as stated above, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Railway, Barauni, Begusarai, in connection with Barauni Rail P.S. Case No. 17 of 2010 arising out of Complaint Case No. 4 C of 2008, subject to the conditions as laid down in section 438(2) of the Cr.P.C. (Jitendra Mohan Sharma, J.) Rajiv/- U T
