2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 414 of the Indian Penal Code.

3. As per prosecution case, the petitioner is alleged to have apprehended by police from whose possession, a stolen motorcycle was recovered for which a case bearing Danapur P.S. Case No. 441 of 2019 has already been lodged.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. It is also submitted vide para-9 of the petition that the petitioner purchased the said motorcycle from a person of Jahalipatti for Rs. 5,000/- but he

Patna High Court CR. MISC. No.61649 of 2023(2) dt.15-09-2023 2/2 does not know that the motorcycle is stolen one. He has no concern with the alleged offence. It is further submitted that the petitioner is languishing in judicial custody since 24.6.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody period, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Supaul (Nadi) P.S. Case No. 60 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul.
