The petitioner seeks bail in anticipation of his arrest in connection with Araria P. S. Case No. 663 of 2016 dated 29.09.2016 instituted for the offences under Sections 420, 406, 409 and 34 of the Indian Penal Code. The sum and substance of the allegation levelled in the F.I.R. is that Principals of various schools, in collusion with others, have siphoned off money which was meant for other purposes.

Learned counsel for the petitioner has submitted that he is not named in the F.I.R. and his name has

Patna High Court Cr.Misc. No.3342 of 2019(2) dt.24-01-2019 2/3 transpired only during the course of investigation and that also by way of a note of a superior police officer during the course of the supervision of this case.

It has further been submitted on behalf of the petitioner that for similar offence, one Savita Devi had earlier lodged a case against the petitioner. This Court has also been made to know that some of the Principals of the various schools who have been named in the F.I.R. have been granted anticipatory bail by different Benches of this Court.

Considering the aforesaid facts as also taking into account the fact that the petitioner is only a villager and was not entrusted with any administrative work of any one of the schools from where funds are alleged to have been siphoned off, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of
