JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 27-07-2022 The learned counsel for the petitioner is directed to remove all the defects pointed out by the office within one month. Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Sheikhopur Sarai P.S. Case No. 71 of 2021 registered for offence punishable under sections 406, 420, 467, 468, 471, 120(B)/34 of the Indian Penal Code.

As per allegation, the police party got an information that some cyber criminals were planning to commit the serious offence in the house of co-accused Neeraj Kumar. The police party came to the house of co-accused Neeraj Kumar and went on the roof of his house. Having seen the police party, the accused persons began to flee away. Three of them were apprehended and

Patna High Court CR. MISC. No.69918 of 2021(2) dt.27-07-2022 2/2 one became successful in fleeing away. The details of articles recovered has been furnished in detail in the FIR. A number of mobile phones, SIM cards, ATM cards, Aadhar cards and bank pass books were recovered from the possession of the apprehended persons and they gave description of chit and forged committed by them by opening forged accounts. The mobile phone of the present petitioner was recovered from the place of occurrence and the apprehended persons named the present petitioner and apprised the police party that the present petitioner was also involved in the alleged occurrence.

It appears that the petitioner is a member of organized gang of cyber criminals and his mobile set with SIM number was recovered from the spot, as such, he does not deserve the privileges for anticipatory bail. Accordingly, his prayer for anticipatory bail is hereby rejected.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
