Learned counsel for the petitioner is permitted to remove the defect(s), as pointed out by the office, if any, within a period of three weeks from today.

The Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 342, 323, 324, 504, 506, 307 and 34 of the Indian Penal Code. Allegation against the petitioner is that on the order of the petitioner, the co-accused Umesh Mandal assaulted Santosh by means of spade with intent to kill.

Learned counsel for the petitioner has submitted that

Patna High Court CR. MISC. No.69785 of 2021(2) dt.08-06-2022 2/2 allegation against the petitioner is general and he has falsely been implicated in this case. He is simply order giver. The petitioner has no criminal antecedent as stated at para 3 of the bail petition.

Learned A.P.P. for the State has opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Supaul P.S. Case No. 473 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Chandra Prakash Singh, J) Gautam/- U T
