Petitioner apprehends his arrest in Complaint Case No.752 of 2018, registered under Section 498A of the Indian Penal Code.
The complainant, wife of the petitioner, alleged that the petitioner demanded Rs.2 lacs for doing business and on 20.06.2018, the petitioner and others subjected her to physical and mental torture.
Learned counsel for the petitioner submits that the marriage of the petitioner was solemnized with the complainant in the year 2000. The complainant got two children from the
Patna High Court CR. MISC. No.55754 of 2019(2) dt.06-09-2019 2/2 wedlock. Petitioner never demanded any dowry nor ever tortured his wife but on account of certain family dispute, the complainant filed this complaint case. The petitioner is still ready to keep his wife.
Taking into consideration the facts that the marriage was solemnized in the year 2000 and the complainant got two children from the wedlock and she was feeling well with her husband but she filed the complaint case only after 18 years of her marriage with the petitioner, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-2, Patna City in connection with Complaint Case No.752 of 2018, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
