The petitioner seeks bail in a case registered for the offences under Sections 461, 379 of the Indian Penal Code. The learned counsel for the petitioner submits that the petitioner is in custody since 27.07.2021, he is a person with clean antecedent, charge-sheet has been submitted and he is a young boy of 21 years.

The learned counsel for the petitioner submits that the informant alleges that when he opened his mobile repairing shop, he found that a theft had been committed and articles worth Rs. 55,000/- has been stolen.

The learned counsel submits that during the course of

Patna High Court CR. MISC. No.69884 of 2021(2) dt.26-04-2022 2/3 investigation based on video footage, petitioner came to be implicated in the present case and there was a recovery of 38 mobiles from his house.

The learned counsel for the petitioner submits that the petitioner deserves a sympathetic consideration from the Court as it is his first offence and is young boy of 21 years of age and if he remains in jail for petty a long time, his entire carrier would get jeopardize and may come in the company of criminals.

Learned A.P.P. vehemently opposes the bail application.

Considering the fact that petitioner is in custody since 27.07.2021, he is a person with clean antecedent, charge-sheet has been submitted and it is his first offence and is a young boy, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sherghati P.S. Case No. 454 of 2021, with a condition that one of the bailor shall be the father of the petitioner (Md. Jubair Alam @ Zubair Alam). The father of the petitioner shall ensure that the
