====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 07-06-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

Learned counsel for the petitioner is permitted to remove the defect(s), as pointed out by the office, if any, within a period of four weeks from today.

This is an application for grant of anticipatory bail in connection with Birpur P.S. Case No. 101 of 2021 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 354(B), 379, 504 and 506 of the Indian Penal Code. The specific allegation against the petitioner is that he has caused hand injury of Parwesh Goit by wooden part of spade. Learned counsel for the petitioner submits that there is land dispute between the petitioner and informant for which there are cases and counter cases instituted between them. It is further submitted that in the first information report the specific allegation

No.70943 of 2021(2) dt.07-06-2022 2/2 against the petitioner is that he has broken the hand of Parwesh Goit, however, the injury report shows the injuries as Swelling and Tenderness on left hand and right elbow joint which are simple in nature caused by hard and solid substance.

Learned A.P.P. for the State has opposed the prayer of bail application of the petitioner.

Considering the fact that there is land dispute between the parties and there are cases and counter cases between them and injuries allegedly caused by petitioner are simple in nature, let the petitioner, above named, in the event of his arrest/surrender before the learned court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Birpur, Supaul in connection with Birpur P.S. Case No. 101 of 2021, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
