The petitioners seek pre-arrest bail in connection with Chausa P.S. Case No. 308 of 2017 registered under Sections 366 read with 34 of the Indian Penal Code. Regard being had to the statement of the victim recorded under Section 164 of the Code of Criminal Procedure

Patna High Court Cr.Misc. No.1043 of 2018 (2) dt.17-01-2018 as contained in Annexure-2 to the present application wherein she has not uttered a word against the petitioners and has named co-accused Mukesh Kumar Sah as the person who committed rape upon her, in the event of arrest or surrender in the court below within six weeks from today, they are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Udakishunganj, Madhepura in connection with Chausa P.S. Case No. 308 of 2017 subject to the conditions as laid down under Section 438(2) Cr. P.C.
